Maternity leave

Maternity leave in India is 26 weeks of paid leave for the first two children (12 weeks thereafter) under the Maternity Benefit Act, for women with 80 days of service in the past year.

The 2017 amendment raised leave to 26 weeks, added 12 weeks for adoptive and commissioning mothers, required crèche facilities for establishments with 50 or more employees, and allowed work from home after the leave by agreement.

Pay during leave is at the average daily wage; ESI-covered employees receive it from ESIC.

In Indian payroll

Dismissal during or because of maternity leave is unlawful. HR should set the leave as a distinct type with its own eligibility check rather than a long EL.
