The contract decides
Notice period and what is recovered for a shortfall come from the appointment letter, the service rules or standing orders. Common periods are 30 days in probation and 30 to 90 days after confirmation.
Days short × salary per day
Recovery is the monthly salary the contract names, divided by 30 or 26, times the days not served. Most contracts use gross; some use basic, which makes the recovery much smaller.
Leave set-off
Some policies let unused earned leave be adjusted against the shortfall instead of being encashed. Others forbid leave during notice. If your policy is silent, the employer decides.
Waivers are common
An employer can release someone early and waive recovery, particularly when the handover is complete. Ask for any waiver in writing before the last day.
Recovered in F&F
Notice pay is deducted from the full and final settlement: last salary, leave encashment and any bonus due. If those are not enough, the employer may ask for the balance to be paid.
The employer's side
An employer ending employment without the notice the contract requires generally pays salary in lieu of notice for the shortfall. The Industrial Relations Code sets separate rules for retrenching workers.
Questions people ask
How is notice period recovery calculated?
Divide the monthly salary named in the contract by 30, or by 26 if the policy uses working days, and multiply by the days of notice not served. On a ₹60,000 gross with 60 days required and 29 served, the recovery is ₹60,000 ÷ 30 × 31, or ₹62,000.
Can earned leave be adjusted against the notice period?
Only if the leave policy allows it. Where it does, each day of leave set off reduces the shortfall by a day, and that leave is not also encashed in the full and final settlement.
Is notice pay recovered on gross or basic salary?
Whichever the appointment letter or policy names. Most say gross salary; if the document says basic, recovery is on basic. Where it is silent, practice varies, so ask HR to confirm in writing.
Can an employer withhold the relieving letter over notice pay?
Employers often hold the relieving letter until the full and final settlement is closed. Refusing it outright over a disputed recovery is difficult to defend; the recovery is a money claim, and the service record is a separate matter.
